October marks the 27th anniversary of the disappearance of eleven-year-old Jacob Wetterling, Jacob was abducted at gunpoint in 1989, 27 years ago. Jacob’s remains were found just one month ago. The American Bar Association’s Model Rules of Conduct sets forth directives for behavior not only for attorneys but for non-lawyers as well and are enforceable in all but eight states. For decades DuPont’s Zinc Smeltering Plant produced layers of contaminated waste that created a 100-foot tall noxious dust mountain in the tiny town of Spelter, West VA, permeating the neighborhoods and infiltrating the West Fork River that surrounded the facility. Ron Dalton was convicted of murdering his wife, Brenda, who died in 1988. Instead, an inexperienced student doctor contributed to her death. Compounding the error of the student doctor, an inexperienced pathologist ruled the death a homicide by strangulation, even though Brenda choked on dry cereal. Dalton was arrested, charged and convicted of second-degree murder. After being sentenced to life in prison, and being incarcerated in a maximum security prison, he spent the following eight years fighting for his innocence. Finally, he was granted a new trial and second jury found him not guilty. Gift of Exoneration: John Artis
In 1966, John Artis was charged along with Rubin Hurricane Carter for the murder of three white Patterson, New Jersey men. John was 19-years old, had never been in trouble, but he was convicted and given a sentence of 25 years to life. Witnesses subsequently recanted their testimony and John and Rubin stood trial ten years later but convicted once again. After spending 15 years in prison, the charges of John Artis and Rubin Hurricane Carter were dismissed, and both were exonerated and released. Investigating the Minnesota River Bridge Collapse
Eight years ago the Mississippi River Bridge was a steel-trussed, eight-lane arch bridge carrying Interstate 35 across the Saint Anthony Falls in Minneapolis, Minnesota. The Gift of Exoneration Series: David Camm
David Camm, a retired Indiana State Trooper, arrived home after playing basketball at a local church one evening and found his wife on the garage floor shot in the head. Her pants and shoes were removed, and her shoes were on top of the family’s Ford Bronco. Their two children, ages five and seven, were found in the backseat of the car, fatally shot as well. David was arrested two days later. In an unfortunate case of police tunnel vision, followed by prosecutorial misconduct, a palm print inside the car was ignored and a prison sweatshirt found next to his wife was dismissed. A name was printed on the back of the sweatshirt. On October 24, 2013, three trials and thirteen years later, David Camm was acquitted and walked a free man. 17 years in prison! Obie Anthony was convicted of a 1994 attempted robbery and the murder of Felipe Gonzales in 1995. The Gift of Exoneration Series: John Edward Smith
In 1993 eighteen-year-old John Edward Smith was identified by a surviving shooting victim who now admits he lied when he testified. Prosecutors also withheld evidence that another individual was responsible for the shooting. John had an alibi, however, his attorney failed to present three witnesses who could verify his whereabouts at the time of the shooting and failed to obtain phone records to support his alibi. After Deirdre O’Connor of Innocence Matters contacted the Los Angeles County District Attorney’s office with this new evidence, the DA re-investigated the case and concluded John was not involved. Gift of Exoneration: Johnny Williams
In March, Johnny Williams of Oakland, CA became one of 29 individuals exonerated in the US in 2013. Through the joint efforts of the No CA Innocence Project (NCIP) and the CA DNA Project, a federally funded unit at NCIP, Johnny was exonerated from 2 counts of forcible lewd conduct & one count of attempted rape of a 9-year-old girl. The girl said “Johnny” did it. Johnny, who was a neighbor & friend of the family, became the suspect. He was subsequently convicted and served 14 years in prison. A forensic examination of the girl’s shirt prior to trial indicated no biological evidence; yet years later testing from both an independent lab & the police department lab yielded a male DNA profile conclusively excluding Johnny. Full disclosure: The host of this show was the defense investigator working for Johnny’s attorney in the pre-trial investigation. Posthumous Exoneration: Timothy Cole
A fear worse than falsely being convicted of a crime as heinous as rape or murder is the fear of dying in prison as an innocent person. That is what happened to Timothy Cole, a military veteran and 26-year-old university student. He was convicted of rape in 1986 when the victim testified to his identity. Despite the confession of the real rapist in 1995, Cole was not released. 19+ years in prison! “Franky Carrillo was convicted of a 1991 murder based on identification testimony from six people, including the victim’s son. All six have now admitted they did not really see anything and were influenced to make their identifications of Carillo. In addition two other men have confessed to the shooting and said Carrillo was not involved … the eyewitness who was the first to implicate Carrillo back in 1991 took the witness stand and apologized to Carrillo, saying he was willing to accept punishment for what he had done because he knew that it was wrong and that he had stolen the life of an innocent man…” (Santa Clara Law News & Events). The Gift of Exoneration: Maurice Caldwell
21 years in prison! Maurice Caldwell was convicted in 1991 of murder in the Alemany Housing Project in San Francisco, CA. No physical evidence connected Maurice to the crime and none of the surviving victims identified him as the shooter. He was convicted solely on the testimony of one person, another example of how eyewitness identification can go wrong and lead to conviction of the innocent. Maurice was released in 2010 after a judge found his attorney to be ineffective for failing to investigate and the post-conviction investigation resulted in a confession from one of the true perpetrators. Also provided were declarations from two witnesses who saw the murder and identified the shooters as people other than Maurice. All three say that Maurice was not involved in any way. 17 years in prison! Obie Anthony was convicted of a 1994 attempted robbery and the murder of Felipe Gonzales in 1995. The conviction, based on the testimony of one witness who operated a nearby house of prostitution, had a prior manslaughter conviction, and was known to carry and use firearms, was overturned in 2011. Northern California Innocence Project Legal Director, Linda Starr, said, “Police purposely ignored and hid evidence that did not support their theory…The prosecution falsely denied that they granted their star witness a deal for his cooperation and failed to correct his lies at trial. And Mr. Anthony’s own attorney failed to investigate the case. For their failures, Mr. Anthony has spent 17 years in prison for a murder he did not commit – and the actual murderer has remained free. Labeled as a Killer: Glestly Waters
Scores of women brutally murdered in Washington and Oregon in the 80’s became known as the Green River Murders. Subsequently Gary Ridgeway confessed. In the interim, Sam “Glesty” Waters was identified by a San Diego police officer as “matching the description of the Green River Killer” after stopping at the site where Waters’ car broke down in San Diego. Those eight words in the officer’s incident report changed the course of Waters life. Two weeks later, he was arrested for attempted murder, kidnapping, robbery, and assault of a prostitute, an unrelated case, and identified as a suspect who was on the run for the Green River murders. Justice Thirty-five Years Too Late
Fifty years ago Joyce Sterrenberg and Tim McKillop were murdered in Scottsdale, Arizona. In 1974, 12 years after the murders, a sheriffs department employee told the police that her estranged husband, Bill Macumber, confessed to her. Macumber, besides being a single father of three, was an army veteran, Little League coach and a member of the Sheriff's Search and Rescue Posse. Bill was tried and convicted in 1975, based mostly on fingerprint evidence. But, the jury never heard about the confession of a drifter who confessed to the murder several years earlier. And, there are suggestions that his ex-wife tampered with the evidence in the old case file that she had access to at the sheriff's office. Macumber, now 76 years old, has served 35 years of his two life setences. The Arizona Justice Project, assisted by private investigator Rich Robertson of R3 Investigations, has been working on his case for nearly a decade. The Arizona Executive Board of Clemency recommended his sentence be commuted, but that was rejected by the governor. Nebraska Dead Man Walking Exonerated

DuPont's Contaminated Mountain Reclaimed
For decades DuPont’s Zinc Smeltering Plant produced layers of contaminated waste that created a 100-foot tall noxious dust mountain in the tiny town of Spelter, West VA, permeating the neighborhoods and infiltrating the West Fork River that surrounded the facility. The toxic air emissions and dust from the operation of one of the largest zinc smelter facilities in the United States became a medical nightmare for scores of local residents exposed to potentially harmful by-products of arsenic, cadmium and lead. In 2004 ten residents filed an environmental class action, known as Perrine v. DuPont, on behalf of themselves and others against the responsible companies for property damages, medical monitoring and punitive damages. Carol Moore was the lead investigator for the law firm who successfully litigated the case on behalf of more than 7000 residents.
